Marijuana Crimes in Georgia

Drug Crime Defense in Marietta

Although marijuana has come under the media spotlight in recent months, it is important to remember that marijuana, also known as cannabis or the street name "pot," is an illegal drug in not only the state of Georgia, but also the entire United States. Under federal laws, any amount of marijuana can be enough to charge a person with a federal drug crime and you may face serious penalties.

If you are found guilty, you could face jail or prison time, fines and be forced to take a mandatory drug awareness course. If you have been arrested, it is imperative that you contact The Merchant Law Firm as soon as possible!

Possession and Sale

The possession of marijuana can have serious consequences and even small amounts can be charged as misdemeanors. If you were found with one ounce or less of marijuana for personal use, you may be facing up to $1,000 in fines and one year in jail.

Any more than one ounce found on you or your property is considered a felony and you may be incarcerated for up to ten years. If you have marijuana with the intent to distribute the drugs, regardless of the amount, you will be charged with a felony crime and you may face anywhere between one to forty years in prison.

Cultivation and Paraphernalia

Cultivation of marijuana is the illegal growing, manufacturing and possession of marijuana plants. The state of Georgia does not recognize marijuana as a valid medicinal drug and even claims that the drug was being cultivated for medical purposes can still have you facing serious charges and penalties. If the cultivation was grown within a thousand feet of a school ground, park or anywhere that children may be present, you will be charged with a felony and face up to forty years in prison and fines exceeding $40,000.

Possession and cultivation are not the only things that can get you in trouble for drug crimes. Paraphernalia that may be used by an individual to smoke, manufacture or cultivate marijuana can leave you being charged with a marijuana crime as well. Possession or sale of any drug paraphernalia is considered a misdemeanor and you may be sentenced with up to one year in jail and pay up to $1,000 in fines if you are convicted of this crime.
